WHAT IS A DEED IN LAW AND ESTATE PLANNING

A deed is a legal document, used to transfer property.  Deeds are drafted for non-contentious probate matters.


NON-CONTENTIOUS PROBATE

 All businesses of non-contentious nature in matters of testacy and intestacy which does not involve any court proceedings. 


WILLS

A Will is document that contains your wishes for the distribution of your property after your death and to appoint guardians for your minor children.


DEEDS OF GIFT

A Deed of Gift is a legal document transferring your property to one or more persons before your death.


LIFE ESTATE DEED

A Life Estate Deed is a legal document where you transfer your interest in the estate to another person and still remain the owner until your death.  The new owner has the right to the property after their death.  However, you still have the right to live, rent, lease or use the property as you please until your death.


TRUSTS

A Trust is a fiduciary relationship in which one person, gives the second person, the right to hold title to property or assets, for the benefit of a third person who is the beneficiary.


PROBATE

 Probate is a legal process for settling an estate, whether one has a will or not.


PROBATE WITH A WILL

 A deceased person who has a will is a testator. When a testator dies, the executor is responsible for starting the probate process.

PROBATE WITHOUT A WILL

INTESTATE ESTATE

A person who dies without a will, is said to have died intestate.  The probate process for an intestate estate includes distributing the deceased assets according to laws of the land. If a deceased person has no assets, probate may not be needed.

CONVEYANCE

A Conveyance is the legal process of transferring your property to one or more persons.


CERTIFICATE OF TITLE

A Certificate of Title is an official document issued by a government agency as proof of ownership of property.


POWER OF ATTORNEY

A Power of Attorney is a legal right given to another person to make decisions about their affairs on their behalf.


RESTERATION OF TITLE

Restoration of title is restoring title deeds that were either lost, stolen, destroyed or damaged.
